Terms and Conditions
Introduction
These terms and conditions govern your use of the Kiwa II Charters website and the booking of charter services. By submitting an enquiry or confirming a booking with Kiwa II Charters, you agree to these terms. Please read them carefully before proceeding.
Bookings and deposits
A deposit is required to secure your selected charter date. Your booking is not confirmed until a deposit has been received. Full payment terms will be provided at the time of booking confirmation. Kiwa II Charters reserves the right to cancel an unconfirmed booking if a deposit is not received within the agreed timeframe.
Cancellation policy
Cancellation terms will be provided at the time of booking confirmation. Kiwa II Charters recommends that clients consider event cancellation insurance for protection against unforeseen circumstances.
Weather and safety
Kiwa II Charters operates in accordance with Maritime New Zealand regulations. Charters will not depart if wind speeds are consistently 40 knots or above. In the event of a weather cancellation, Kiwa II Charters will work with the client to reschedule where possible. The skipper's decision regarding vessel safety is final.
Alcohol and licensing
Kiwa II operates a fully licensed onboard bar in accordance with New Zealand liquor licensing laws. BYO alcohol is not permitted under any circumstances. Kiwa II Charters reserves the right to refuse alcohol service in accordance with its obligations under the Sale and Supply of Alcohol Act 2012.
Catering
Clients may arrange their own catering. All food must be pre-prepared before boarding. A dedicated crew member will assist with service and reheating where required. Kiwa II Charters accepts no responsibility for the quality or safety of client-supplied food.
Conduct and safety requirements
Kiwa II Charters operates under Maritime New Zealand regulations and holds a current Large Vessel Licence Authority (LLA). All guests must follow crew instructions at all times. Flat-soled footwear is recommended. Kiwa II Charters reserves the right to refuse boarding or remove any guest whose conduct poses a risk to the safety or enjoyment of others onboard.
Corporate branding
Corporate logos and flags are permitted with prior skipper approval. Crepe paper, tinsel, and similar decorations are not permitted onboard under any circumstances.
Music
Personal devices may be connected to the onboard sound system. External speakers are not permitted. Kiwa II Charters reserves the right to manage onboard sound levels at the skipper's discretion.
Liability
Kiwa II Charters takes all reasonable steps to ensure the safety and enjoyment of all guests. To the extent permitted by New Zealand law, Kiwa II Charters accepts no liability for loss, damage, or injury sustained onboard except where caused by the negligence of Kiwa II Charters or its crew.
Changes to these terms
Kiwa II Charters reserves the right to update these terms and conditions at any time. The current version will always be available at www.kiwa2charters.com/terms. Continued use of our services following any changes constitutes acceptance of the updated terms.
